Disney Movie Club Member Privacy Policy

Your privacy is important to the Disney Movie Club (referred to as "we," "us," "our," and "ourselves" in this Privacy Policy) and this Privacy Policy is designed to answer your questions regarding our privacy policies and principles.



A1. This Privacy Policy applies to all personally identifiable information that we collect from individuals who provide us such information for the purpose of enrolling in and ordering products from the Disney Movie Club.

If you visit our Web site and do not enroll in the Disney Movie Club, personally identifiable information you provide when you make a non-member request for promotional materials will be subject to the provisions of this Privacy Policy described in A9 below.

As used in this Privacy Policy, "The Walt Disney Family of Companies" includes The Walt Disney Company and all of its subsidiary and affiliated entities, singly or together, including companies such as ABC and ESPN that generally do not offer their products and services under the "Disney" brand name, as well as companies that generally do offer their products and services under the "Disney" brand name, but does not include the Disney Movie Club. The Disney Movie Club is operated by the Buena Vista Catalogue Co., 350 South Buena Vista Street, Burbank, CA 91521-6524.

When this Privacy Policy uses the term "personally identifiable information," we mean information that identifies a particular individual, such as the individual's name, postal address, e-mail address, and telephone number. When other information (such as, for example, movie preferences or number of children) is directly associated with personally identifiable information, this other information also is treated as personally identifiable information for purposes of this Privacy Policy. Personally identifiable information is sometimes referred to in this Privacy Policy as "personal information". Finally, the terms of this Privacy Policy are subject to all applicable laws.
A2. We collect several types of personally identifiable information about Disney Movie Club members.

Information You Provide to Us

When you enroll in and order products from the Disney Movie Club, we collect personally identifiable information about you. Typically, this information includes your name, postal address, e-mail address, telephone number, credit card information, the products ordered, and the date of the order. We also may collect other types of information such as gender, age, number of children, and movie interests, which we may associate with personally identifiable information. We may collect personal information when you enroll on, log on, or visit our Web site while a Disney Movie Club member, including when you participate in activities on our Web site, such as sweepstakes, contests, games, and informational and promotional offers, and when you provide information to our customer service representatives.

Our Web site may offer message boards, conversation pages, chat rooms, social community environments, profile pages, and other Public Forums (as defined in the Terms of Use governing our Web site (the "Terms of Use")) for Disney Movie Club members, as well as other features in which Disney Movie Club members may provide us with Submissions (as defined in the Terms of Use). If you provide personal information when you use any of these features, that personal information may be publicly posted and otherwise disclosed without limitation as to its use by a third party. Our rules regarding Submissions are described in the Terms of Use, including in the "Submissions," "Licenses and Representations," "Public Forums and Communication" and "Rules of Conduct" sections of the Terms of Use.

Information Collected Through Technology

When you enroll in and order products from the Disney Movie Club Web site or visit our Web site, we collect information through technology to make our Web site more interesting and useful to you and for various purposes related to our business. For instance, when you come to our Web site, we collect your IP address. An IP address is associated with the access point through which you enter the Internet, and is typically controlled by your Internet Service Provider (ISP), your company, or your university. Standing alone, your IP address is not personally identifiable. We may use IP addresses to collect information regarding the frequency with which you visit various parts of our Web site, and we may combine IP addresses with personally identifiable information.

Our Web site collects information through a variety of technical methods, including cookies and Web beacons. Cookies are pieces of information that a Web site sends to your computer while you are viewing the Web site. Web beacons are small pieces of data that are embedded in images on the pages of Web sites. Cookies, Web beacons and other technical methods may involve the transmission of information either directly to us or to another party authorized by us to collect information on our behalf.

We may use the information collected through these technical methods for many purposes, including delivering content, tracking and enhancing your experience on our Web site. For example, when you return to our Web site after logging in, cookies provide information to the site so that the site will remember who you are. We also may use technical methods to analyze the traffic patterns on both our Web site (such as the frequency with which our users visit various parts of our Web site) and on third party Web sites (such as the frequency with which our users visit other Web sites). In HTML e-mails that we send you, we may use technical methods for a number of purposes, including to determine whether you have opened or forwarded those e-mails and/or clicked on links in those e-mails, to customize the display of banner advertisements and other messages after you have closed the e-mail, and to determine whether you have made an inquiry or purchase in response to a particular e-mail. These technical methods may enable us to collect and use information in a form that is personally identifiable.

Information We Collect from Others

We may update and supplement personally identifiable information that we have collected directly from our Disney Movie Club members with other information that we obtain from third parties and members of The Walt Disney Family of Companies. When we associate information that we obtain about Disney Movie Club members from third parties or members of The Walt Disney Family of Companies with personally identifiable information that we have collected under this Privacy Policy, we will treat the acquired information like the information that we collected ourselves.
A3. Your personally identifiable information, including your e-mail address, may be used by Disney Movie Club for operational, promotional and other purposes, including to:

  • Process your enrollment in Disney Movie Club;
  • Review your credit worthiness for participation in Disney Movie Club;
  • Send you order confirmations and reminders and fulfill your orders with Disney Movie Club;
  • Identify your Disney Movie Club purchasing preferences;
  • Establish your eligibility for special Disney Movie Club offers and discounts;
  • Process payment on your credit card for Disney Movie Club purchases;
  • Send you promotional information about Disney Movie Club and advise you of merchandise or product offerings as well as other special offers including online newsletters and offers;
  • Inform you of Disney Movie Club member surveys, contests and/or sweepstakes that may be of interest; and
  • Notify you of other Disney Movie Club developments and send you offers from third parties that may be of interest.


  • After you fulfill your commitment to purchase movies from Disney Movie Club, you will continue to receive promotional materials from Disney Movie Club (for example, promotional information about Disney Movie Club, our merchandise and product offerings, discounts on movies, as well as special offers including online newsletters and offers), unless you terminate your Disney Movie Club membership. You may request that your membership be terminated at any time after you fulfill your commitment by calling or writing Disney Movie Club's customer service at the telephone number or address in A10 below. If you request to terminate your membership as described in the immediately preceding sentence, our systems require time to update, and promotional mailings using your personal information may already be in process. Therefore, you may continue to receive promotional materials from Disney Movie Club for up to thirty (30) days (unless a shorter time period is required by applicable law) after the termination of your membership.

    You will automatically receive Disney Movie Club communications via e-mail, unless we do not have a valid e-mail address for you. If you wish to receive communications from the Disney Movie Club only at your postal address and not by e-mail, please register your preference by calling or writing Disney Movie Club's customer service at the telephone number or address in A10 below.

    If you need to update your e-mail address or have not provided an e-mail address and want to sign up for Disney Movie Club communications via e-mail, please visit the "My Profile" area of www.disneymovieclub.com to update or provide your e-mail address. In addition, you also may update or provide your e-mail address by calling or writing Disney Movie Club's customer service at the telephone number or address in A10 below.
    A4. Except as otherwise disclosed to you, we will not share your personally identifiable information with third parties without first notifying you of our intent and providing you an opportunity to prevent your personally identifiable information from being shared.

    The Walt Disney Family of Companies

    Unless you opt out of receiving promotional materials from The Walt Disney Family of Companies, either at the time you enroll in Disney Movie Club or thereafter by following the opt out directions in A5 below, you consent by providing your personal information to Disney Movie Club and becoming a Disney Movie Club member to our sharing your name, e-mail address and postal address with members of The Walt Disney Family of Companies so that they can send you promotional materials about their products and services.

    Select Third Parties not Part of The Walt Disney Family of Companies

    In addition, by providing your personal information to Disney Movie Club and becoming a Disney Movie Club member, you consent to our sharing your name and postal address (but not your e-mail address) with other reputable companies (third parties not part of The Walt Disney Family of Companies) selected by us so that they can send you promotional materials about their products and services, unless you opt out of receiving promotional materials from these other reputable companies, either at the time you enroll in Disney Movie Club or thereafter by following the opt out directions in A5 below.

    We also may offer joint promotions or programs that will require personal information be shared with third parties in order to participate. In such instances, we will obtain your consent to such sharing at the time you participate in such joint promotion or program. Any opt-out choices you make under A5 below will not apply to this sharing.

    Companies That Facilitate Disney Movie Club's Communications and Transactions with You

    We use other companies, agents or contractors to perform various services on our behalf. For example, we have engaged Walt Disney Internet Group ("WDIG") and other companies to process requests on our behalf. In addition, we have engaged Alta Resources, Inc. ("Alta") to support our call center, process requests and fulfill orders on our behalf. We also engage other companies to process credit card transactions and collect debts. In the course of providing services on Disney Movie Club's behalf, these other companies may have access to your personal information. By providing your personal information to Disney Movie Club and becoming a Disney Movie Club member, you consent to our sharing some or all of your personally identifiable information with these third party service providers and their successors. Any opt-out choices you make under A5 below will not apply to this sharing. By contract, these third party service providers are not permitted to use your personally identifiable information for any purposes other than providing the services we request from them and facilitating compliance with laws. Finally, we also provide postal addresses to the U.S. Post Office for the purpose of delivering your selections.

    Sale of Business, Debt Collection and Disclosures to Comply With Laws

    We may disclose Disney Movie Club members' personally identifiable information (a) in the event ownership of the Disney Movie Club is transferred, (b) for purposes of debt collection and (c) when we believe in good faith that such disclosure is required by law, including for example, to comply with an appropriate court order, warrant or subpoena. Any opt-out choices you make under A5 below will not apply to this sharing.
    A5. As described above, Disney Movie Club may share your personal information with members of The Walt Disney Family of Companies and/or third parties so that they may send you promotional materials. If you do not wish Disney Movie Club to share your personal information with members of The Walt Disney Family of Companies and/or third parties for this purpose, you may exercise your opt out choices when you enroll in Disney Movie Club. If you did not exercise your opt out choices when you enrolled and do not want your name, e-mail address (in the case of members of The Walt Disney Family of Companies only) and postal address shared with members of The Walt Disney Family of Companies and/or other third parties, call or write Disney Movie Club's customer service at the telephone number or address in A10 below. From time to time, Disney Movie Club may provide additional methods for modifying your opt-out choices.

    Finally, if you do not exercise your opt out choices when you enroll in Disney Movie Club, it may take up to thirty (30) days (unless a shorter time period is required by applicable law) for Disney Movie Club to stop sharing your personal information for promotional purposes with members of The Walt Disney Family of Companies and/or other third parties.
    A6. The security and confidentiality of your information is extremely important to us. We have implemented technical, administrative, and physical security measures to protect guest information from unauthorized access and improper use. From time to time, we review our security procedures in order to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable.
    A7. You can access and update the contact information you gave us during enrollment (that is, your postal address, e-mail address, or any other information that would directly enable us to contact you) by going to the My Profile section when you log on to www.disneymovieclub.com. We also may provide you an opportunity to update your contact information and/or modify your opt out choices by sending you an e-mail or other communication that invites your response. Finally, you may unsubscribe from certain e-mail communications by clicking on unsubscribe links in those e-mails. In addition, you may update your contact information and/or modify your opt out choices by calling or writing Disney Movie Club's customer service at the telephone number or address in A10 below. From time to time, we may provide additional methods for updating your contact information and/or modifying your opt out choices.
    A8. We retain a Disney Movie Club member's personally identifiable information only as long as necessary to service a member's Disney Movie Club membership and maintain an accurate record of our relationship with you, in accordance with law.
    A9. If you visit our Web site and do not enroll in the Disney Movie Club, the following paragraphs of this "Non-Member Requests for Promotional Materials" section describe the provisions of this Privacy Policy that apply to you. As a non-member, you may request that Disney Movie Club and The Walt Disney Family of Companies send you promotional materials regarding our and their products and services. When you request promotional materials and do not enroll in the Disney Movie Club: (a) personally identifiable information that you provide when you make your request (typically your name, e-mail address and postal address) will be shared with The Walt Disney Family of Companies, and (b) you may opt out of receiving promotional materials from us and The Walt Disney Family of Companies by calling or writing Disney Movie Club's customer service at the telephone number or address in A10 below. Please note that if you opt out and subsequently make another non-member request for promotional materials, you again grant permission to us and The Walt Disney Family of Companies to send our and their promotional materials to you.

    It may take up to ninety (90) days for us and The Walt Disney Family of Companies to stop using your personal information for promotional purposes. If you have not consistently used the same email address and postal address when making requests for promotional materials, or if you have used a general change of address process (such as the change of address process offered by the U.S. Post Office) after providing address information, systems maintained by us and members of The Walt Disney Family of Companies may have varying contact information for you. Accordingly, it may not always be possible to match your opt out choice with the personal information you previously provided.

    We may disclose non-members' personally identifiable information to third party service providers for us and The Walt Disney Family of Companies. We also may disclose non-members' personally identifiable information (i) in the event ownership of the Disney Movie Club is transferred and (ii) when we believe in good faith that such disclosures (a) facilitate compliance with laws, including, for example, compliance with a court order, warrant or subpoena, or (b) will help to protect your safety or security, including the safety and security of property that belongs to you; and/or, protect the safety and security of our Web site, The Walt Disney Family of Companies, and/or other third parties, including the safety and security of property that belongs to The Walt Disney Family of Companies or other third parties.

    A11. We may amend this Privacy Policy at any time. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by postal mail, by sending you an e-mail at the last e-mail address that you provided us, and/or by prominently posting notice of the changes on our Web site covered by this Privacy Policy, and such change will become effective either within ten (10) days of sending you the postal mail or e-mail notice, within thirty (30) days of posting on our Web site, or as otherwise agreed by you. Please note that, at all times, you are responsible for updating your personal information to provide us your current contact information. In the event that the last postal address and/or e-mail address that you have provided us is not valid, or for any other reason is not capable of delivering to you the notice described above, our dispatch of the postal mailing and/or e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. In any event, an amendment to this Privacy Policy may permit material changes in the way we use and share personal information that you provided us prior to our notification to you of such amendment. If you do not wish to allow such material changes, you must so notify us (in the manner we specify) prior to the effective date of the amendment. If you provide us this notice, we may choose to terminate your Disney Movie Club membership. Please be advised, however, that, regardless of whether you provide such notice to us, any such amendment to this Privacy Policy will apply to any personal information that you provide us on or after the effective date of such amendment.

    A12. California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
